Comments on the new ClickBank User Agreement

By eProfitNews.org | March 18th, 2009

ClickBank has revised their User Agreement. I’ve just skimmed through the rather long document (which you will see when you next login to your CB account).

When there is a revision like this, the obvious question is… What’s changed?

They don’t say.

But two sections jumped out at me (not sure if these are new or if I just noticed them):

4. SENDING EMAILS.

You shall not directly or indirectly:

3. Employ any false or deceptive information regarding Your identity, or regarding the intent, subject, or origin of the message or fail to include accurate information regarding Your identity, and the intent, subject, and origin of the Email.

I wonder what impact this will have on folks who promote using pseudonyms. False names, it seems, have become a problem here.

What’s your view? – please comment below.

Maybe, instead of signing off as Bill Brown unless that’s your real name, you just sign off your emails as www.MyDomain.com

***

Under section 6, I notice…

Promotional use of images or reproductions of Payment checks issued by ClickBank without the express, written consent of ClickBank is prohibited.

***

Hope my comments help in some way, but you should not rely on them. I’m not a lawyer (and wouldn’t want to be one — I’ve heard that lawyers as a group have a higher than average rate of being clinically diagnosed as suffering from depression).

I think this has been a problem for along time accross a lot of affiliate networks.

There are many ways to exploit this, none of which I will mention here. Bottom line is, you should be transparent about where you are emailing from and who you are emailing and why.

  3. Kathy@orange county wrongful death attorney Says:

I think it is intended to reduce potential liability to them, since they are indirectly making a profit and liable under spamming laws.

  4. admin@london escorts Says:

Same with Bob, I am also totally new with WAMU. Where can we find about it? Would it be nice if you can post a topic about it? thanks!

  5. Frank Says:

This seems to be mostly about spam liability. If the autorities can’t find who’s behind a certain spammer’s curtain, guess who they turn to: CB. I’d say its an understandable move on their part.

  6. @ london escorts Says:

Kathy I guess you are right they are trying to reduce liability. comment is acting here as a sign. by signing the document users are agree and liable for their action.

It is so easy to spot an online scam. First they won’t give you any information about the business untill you give them some money, or you have to take their CD. After receiving the CD you will be hit with nothing more than a motivational pitch with no real insight as to what you are getting into unless you send them some money. Anyone with a ligitamate business opertunity is usually proud of their business and will be glad to talk to you in depth about the business and what is required and what they are all about, either by e-mail. phone or personal contact.

  25. Karl Says:

There are more clickbank terms and conditions that I’ve seen many people including popular ones ignore – probably because they never read them… such as:

Include the We’re not affiliate with clickbank disclaimer at bottom of salesletter + thank you page. Plus you can’t use clickbank logo (something everybody does)…

I think this was a good step, unfortunately clickbank is used by many spammers as well as people publishing fake income reports or similar to lure visitors into buying products. The new policy doesn’t affect honest vendors, only those applying fishy promotional techniques.
